Partners Raphaelson & Levine and the entire Attorney Legal Team visited Albany this week to lobby the Senate and Assembly regarding proposed bills for consumer and accident victim rights. The bills we advocated for are important bills that are important to every family in New York. We support the grieving families act which seeks to change New York's wrongful death laws. Families that grieve are entitled to compensation. Presently the law in New York does not allow any recovery for mental anguish or suffering that a spouse or child goes through as a result of the loss of a family member. New York only allows for economic loss not non- economic loss. The law has no provisions for valuing the loss of a child or elderly person or for that matter any person who has not employed any earning income at the time of the accident. New York surprisingly to most is way behind most of the country in this area of law.
