Our client, a 50-year-old construction worker, was a using a ladder to perform alterations to a ceiling and pipe in the kitchen of an NYC restaurant. According to a recent report published by the U.S. Department of Labor, construction accidents are most often a result of noncompliance with well-established Occupational Safety and Health Administration (OSHA) standards. The report made particular mention of accidents involving stairway and ladder hazards that cause injuries to construction workers.
Regulations that address stairway and ladder accidents need to be updated to better protect construction site workers from injury.
OSHA estimates that each year there are as many as 36 fatalities and 24,882 injuries due to falls on stairways and from ladders on construction sites. A recent corollary study of 1,400 ladder accidents by the Bureau of Labor Statistics found that:

- Sixty-one percent of the ladders involved in the accidents had not been secured at the top.
- Fifty-three percent of the ladders involved in the accidents broke during use.
